Privacy Policy

Effective October 14, 2026 | Privacy Policy version 2026-10-14.3 | Applies to crewtank.com and crewtank.app

1. Scope and who we are

This Privacy Policy describes how CrewTank LLC ('CrewTank,' 'we,' 'us') collects, uses, discloses, retains, and protects personal information through crewtank.com, crewtank.app, and associated worker, applicant, and contractor workflows. It applies to Platform users, prospective workers, employees, contractor contacts, and website visitors. Additional employee notices, biometric notices, benefits documents, and vendor disclosures may apply to specific activities.

2. Information we collect

Depending on your relationship with CrewTank and the features you use, we may collect: contact and account information (name, address, email, phone, login details, company affiliation); trade and employment information (skills, credentials, work history, availability, assignments, time records, wage rates, and employment documents); identity and eligibility information (government identification, Social Security number, tax and Form I-9 information, and employment authorization records); payment information (bank details and payroll-related information); and safety, incident, workers' compensation, and benefits information where relevant. We may also collect jobsite clock-in/clock-out geolocation, reference and timekeeping photographs, facial verification data where enabled, device and usage information, IP addresses, cookies, website analytics, communication preferences, and records of consents and acknowledgments. Background-screening information may be processed through a screening provider such as Checkr, subject to separate legally required notices and authorizations. We collect voluntary demographic self-identification information for applicable compliance purposes and restrict its use and access.

3. Sources of information

We receive information from you, participating contractors, your authorized representatives, our service providers, employment and identity verification systems, and lawful public or government sources where appropriate. We may obtain assignment hours, site information, and incident reports from participating contractors.

4. How we use information

We use personal information to evaluate applications and eligibility; administer hiring and employment; match workers to potential assignments; schedule, dispatch, and communicate; verify time and attendance; process payroll, taxes, benefits, invoices, and workers' compensation matters; investigate incidents and address safety issues; provide support; secure and improve the Platform; detect misuse; maintain required records; and comply with legal obligations. We do not use voluntary demographic responses to determine hiring, assignment, compensation, or other employment outcomes. We do not use biometric information for unrelated advertising.

5. Facial verification and biometric information

CrewTank offers optional facial verification for timekeeping. Workers who separately consent may provide a reference photograph and clock-in or clock-out photographs processed using facial comparison technology, including AWS Rekognition, to help verify identity. The separate Biometric Information Policy and Consent, in the version presented to the worker at the time of consent, explains the categories, purposes, authorized service providers, retention rules, and consent choices. CrewTank does not sell biometric identifiers or biometric information. A worker may decline or withdraw biometric consent and use a staff-verified alternative timekeeping process without loss of employment or earned wages. Clock photographs and associated comparison results are scheduled for deletion from active systems within 90 days after capture; reference photographs and associated facial data within 30 days after employment ends. Following withdrawal, biometric data no longer required for an authorized purpose is scheduled for deletion from active systems within one day, except information subject to a legal preservation obligation. Backup copies expire under the applicable backup lifecycle, which may differ from active-system deletion. A legal hold suspends deletion only for records it covers until the hold is lifted. Consent and audit records may be retained separately as legally required. For requests contact privacy@crewtank.app.

6. Location information

Precise jobsite location verification is optional and subject to a separate Location Consent (v2026-10-14). For workers who opt in, CrewTank collects location at clock-in and clock-out to help verify the designated worksite; CrewTank does not use this feature for continuous background location tracking. Workers who decline or withdraw location consent may use staff-verified timekeeping without loss of employment or earned wages. Device permissions can be changed, but changes may require staff verification of time entries.

7. When we share information

We may share information with participating contractors to the extent reasonably necessary for assignment scheduling, qualification checks, site access, timekeeping, safety, and incident management. We may also share relevant data with payroll and tax processors, banks, benefits administrators, cloud hosting and identity-verification providers, background-screening providers, communications vendors, insurers, claims administrators, legal advisers, auditors, and government authorities where appropriate or required by law. We limit access according to operational needs and applicable agreements. Contractors do not receive unrestricted access to sensitive employee records merely because a worker is assigned to their site. We do not sell personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not share mobile phone numbers or SMS opt-in information or consent with third parties or affiliates for their own marketing or promotional purposes; operational messaging vendors may process information solely to deliver authorized messages on our behalf.

8. SMS communications

If you affirmatively opt in, we use your mobile number and messaging consent to send CrewTank work alerts, including assignments, schedule changes, check-in issues, safety notices, and pay notifications. Consent is optional and is not a condition of employment. Message frequency varies and carrier charges may apply. Reply STOP to opt out or HELP for assistance. We retain appropriate consent and opt-out records. See the SMS Terms in the Terms of Service for support contact details.

9. Cookies and website analytics

CrewTank uses essential cookies and similar technologies for account access, authentication, security, and session continuity. On crewtank.com, CrewTank uses Google Analytics 4 (measurement ID G-GFKYCWFL7R) and website-host analytics to understand website traffic, usage, and performance. These services may process IP addresses, device and browser information, page views, and interaction events, subject to their configurations and privacy terms. On crewtank.app, CrewTank uses Sentry for application error monitoring and some session recordings to diagnose failures and improve reliability. Sentry may process device, usage, diagnostic, and session interaction data. CrewTank seeks to limit sensitive information captured in monitoring tools. Available browser settings and legally required privacy choices may limit certain cookies or analytics; disabling them may affect some features. CrewTank does not use biometric data for advertising.

10. Retention and deletion

CrewTank retains employment, payroll, tax, immigration, benefit, safety, workers' compensation, and related records for the periods required by applicable law or reasonably needed for legitimate administration, disputes, and claims. Different record categories have different schedules. For optional biometric verification, the active-system deletion schedule is: clock photographs and comparison results within 90 days of capture; reference photographs and associated facial data within 30 days after employment ends; and, following withdrawal of consent, biometric data no longer required for an authorized purpose within one day. These periods do not override a legal preservation obligation. Backup copies are removed through the applicable backup expiration cycle, which is separate from deletion in active systems. Where a legal hold applies, the affected information is preserved until the hold ends and then processed under the applicable retention schedule. Non-biometric consent and audit logs may have longer lawful retention periods.

11. Security

CrewTank maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and loss. These safeguards include measures appropriate to the sensitivity of the information and the systems in which it is maintained. No electronic system or method of transmission can be guaranteed completely secure.

12. Your choices and privacy requests

You may request access to, correction of, or deletion of personal information by contacting privacy@crewtank.app. We will respond consistent with applicable law and may need to verify your identity. Certain employment, payroll, tax, immigration, insurance, or litigation records cannot be deleted on request when retention is legally required. Where applicable, you may exercise additional privacy rights under state law without unlawful retaliation or discrimination. SMS preferences may be changed by replying STOP to a message.

13. Children and external services

The Platform is intended for adult contractors, applicants, and workers, and is not directed to children. Third-party services linked from the Platform may maintain their own privacy notices; their practices are governed by those notices where applicable.

14. Changes to this Policy

We may update this Policy to reflect changes in our services, practices, or legal requirements. We will post the revised Policy with a new effective date and provide additional notice or obtain consent where required.

Terms of Service

Terms of Service

Effective October 14, 2026 | Terms of Service version 2026-10-14.2 | Applies to crewtank.com and crewtank.app

1. Acceptance and scope

These Terms of Service ('Terms') govern access to and use of the CrewTank websites at crewtank.com and crewtank.app, and related pages, forms, accounts, and digital tools (collectively, the 'Platform'). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. CrewTank LLC ('CrewTank,' 'we,' 'us') may update these Terms. We will post the updated version and effective date and provide additional notice or obtain consent where required by law. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.

2. Platform and workforce services

CrewTank operates a construction workforce network and supporting digital platform for contractor participation, worker onboarding, assignment requests, matching, scheduling, timekeeping, communications, and employment administration. CrewTank offers distinct contractor arrangements, including Module P (a co-employment arrangement for participating contractors converting existing crews) and Module T (project-based assignments using workers in the CrewTank network), as defined in applicable signed agreements. The Platform itself does not guarantee that any worker, trade, assignment, schedule, or quantity of labor will be available. Registering, applying, or creating an account does not by itself establish an employment relationship. Employment begins only through applicable hiring and onboarding processes. The identity of the employing entity and any co-employment allocation are governed by the applicable employment documents and signed contractor agreement.

3. Relationship to other agreements

These Terms govern general Platform access and conduct. Contractor services, rates, payment, insurance, allocation of employment duties, jobsite safety, assignment releases, and recalls are governed by the applicable signed Client Service Agreement ('CSA'), schedules, and written confirmations. In a conflict concerning those contractor services, the signed CSA and applicable schedules control. Employee wages, benefits, assignments, employment policies, consents, and acknowledgments are governed by the applicable employment documents and law. Nothing in these Terms waives or limits nonwaivable rights or duties, including wage, workplace safety, workers' compensation, discrimination, or privacy protections.

4. Eligibility, accounts, and security

You must provide accurate and current information and keep your account credentials confidential. You may not impersonate others, permit unauthorized use, interfere with Platform security, scrape data without authorization, or use the Platform unlawfully. Notify CrewTank promptly if you suspect unauthorized access. We may restrict accounts for security or violations, subject to applicable law and contractual obligations.

5. Contractor responsibilities

Contractors remain responsible for directing and supervising work at their jobsites, communicating site-specific hazards, providing and enforcing required jobsite safety measures, and meeting applicable legal obligations. Contractors must accurately verify and report work performed, cooperate with incident investigations, and promptly report injuries, hazards, and disputes using the required program procedures. Matching and dispatch tools may recommend workers based on qualifications, location, and availability. Selection, assignment, acceptance, release, and recall are subject to the applicable CSA, program rules, worker eligibility, and availability. No particular worker or response time is guaranteed. Rates and invoice obligations are controlled by signed agreements and approved schedules, not by this Platform document.

6. Worker responsibilities and timekeeping

Workers must provide accurate information, maintain qualifications required for assigned work, follow lawful worksite instructions and safety rules, and accurately report all compensable hours. GPS location checks and facial/photo verification are optional, separately consented features. Workers who do not opt in may use staff-verified timekeeping. A missing location reading, failed photo comparison, technical error, or contractor dispute does not eliminate compensable hours or permit CrewTank to withhold wages owed under applicable law. Availability settings and assignment requests do not guarantee employment, a minimum number of hours, or any particular assignment. Employment-related decisions and rights are subject to applicable employment documents and law.

7. Electronic records and communications

Where applicable, separate electronic-records and signature consents govern employment documents and acknowledgments. You may receive operational notices through the Platform, email, or other lawful methods. SMS messages are governed by the SMS terms below and the separate consent collected in the relevant workflow.

8. SMS work alerts

Workers may separately opt in to receive CrewTank work alerts, including shift offers, assignment details, schedule changes, check-in issues, safety notices, and pay notifications. Message frequency varies; message and data rates may apply. Reply HELP for assistance or STOP to opt out when the sending number supports these commands. After STOP, a confirmation message may be sent. Consent to optional texts is not a condition of employment. For assistance contact hr@crewtank.app or call (844) 521-3600. This telephone number is provided for voice assistance and is not represented as SMS-enabled. Mobile carriers are not liable for delayed or undelivered messages. See the Privacy Policy at crewtank.app/privacy (also applicable to crewtank.com) for information about mobile information and messaging consent. Legally required employment notices may still be delivered through other lawful channels.

9. Intellectual property and acceptable use

CrewTank and its licensors retain their rights in the Platform, software, content, trademarks, and related materials. You receive a limited, revocable, nontransferable right to use the Platform for its intended purposes while authorized. Do not reverse engineer, reproduce, resell, disrupt, or misuse the Platform except as allowed by law or written agreement.

10. Platform availability and disclaimers

We work to maintain the Platform but do not promise uninterrupted, error-free operation. To the extent permitted by law, the Platform's informational and technical functions are provided 'as is' and 'as available.' This disclaimer does not modify CrewTank's express obligations under a signed CSA, employment agreement, or applicable law, and does not disclaim duties that cannot legally be waived.

11. Limitation of liability

To the maximum extent permitted by applicable law, CrewTank is not responsible under these Platform Terms for indirect, special, incidental, or consequential damages arising solely from Platform use. This limitation does not override the CSA's negotiated liability provisions, nonwaivable statutory rights, wage obligations, or liability that cannot lawfully be excluded. No monetary cap is established by these Platform Terms for separate contractor or employment obligations.

12. Governing law and disputes

Arizona law governs these Platform Terms, without regard to conflict-of-laws rules, except where another law must apply. Subject to applicable mandatory rights, and except as provided in a controlling signed agreement, disputes concerning Platform access may be brought in the state or federal courts in Maricopa County, Arizona. Employment disputes, statutory claims, and CSA disputes remain subject to their applicable laws and controlling agreements.
